Terms and Conditions
1. Scope
The following terms and conditions apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person, or a partnership with legal capacity, who, when concluding a legal transaction, acts in the exercise of their trade, business or profession.
2. Contracting party, conclusion of contract, possibility of correction
The purchase contract is concluded with TCW Betriebsgesellschaft mbH.
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. You can initially place our products in the shopping basket without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. By clicking the order button, you submit a binding offer for the products contained in the shopping basket. Confirmation of receipt of your order is sent by email immediately after the order is submitted.
We accept your offer within two days by
- issuing a declaration of acceptance in a separate email, or
- where applicable, the payment transaction being carried out by our service provider or the selected payment provider. The time of the payment transaction depends on the selected payment method (see “Payment”).
The alternative relevant to you depends on which of the listed events occurs first.
3. Contract language, storage of the contract text
Language(s) available for the conclusion of the contract: German
We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. Delivery conditions
Standard delivery is free of shipping charges.
Delivery options
We ship the products to the delivery address given in the ordering process.
In principle, you have the option of collecting your order from Kochwerk.Berlin, Roelckestr. 105, 13088 Berlin, Germany during the following business hours: by appointment
We do not deliver to packing stations.
5. Payment
In our shop, the following payment methods are generally available to you.
Payment processing via PayPal Services
In cooperation with the payment service PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), we offer you various payment methods as PayPal Services.
PayPal
In order to pay the invoice amount via PayPal, you must be registered with PayPal, authenticate yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal after the goods have been shipped. You will receive further information during the ordering process.
PayPal may offer additional payment options in the customer account to registered PayPal customers selected according to its own criteria. However, we have no influence on the offering of these options; any additional payment options offered individually concern your legal relationship with PayPal. You can find further information on this in your PayPal account.
Credit card
You do not need to be registered with PayPal in order to pay the invoice amount. During the ordering process, you provide your credit card details. The payment transaction is carried out by your credit card company at PayPal’s request immediately after confirmation of the payment instruction and your authentication as the lawful cardholder, and your card is charged.
Direct debit
You do not need to be registered with PayPal in order to pay the invoice amount. On the PayPal website, you can provide your payment details, confirm the use of your data by PayPal and the payment instruction to PayPal. By confirming the payment instruction, you issue a direct debit mandate to PayPal. You will be informed by PayPal of the date of the account debit (so-called prenotification). Upon submission of the direct debit mandate immediately after confirmation of the payment instruction, PayPal requests its bank to initiate the payment transaction. The payment transaction is carried out and your account is debited.
6. Retention of title
The product remains our property until full payment has been made.
7. Warranty and guarantees
Liability for defects
Statutory liability for defects applies.
Guarantees and customer service
Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.
8. Dispute resolution
We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
9. Youth protection
If your order includes products whose sale is subject to age restrictions, we ensure by using a reliable procedure involving personal identity and age verification that the purchaser has reached the required minimum age. Where a delivery takes place, the deliverer hands over the goods only after the age verification has been carried out and only to the purchaser in person.
